ACEIT SPORTSWEAR PTY LTD – TERMS & CONDITIONS

These Terms and Conditions govern all purchases made from Aceit Sportswear Pty Ltd (ABN: [insert]), trading as Aceit (“we”, “us”, “our”). By placing an order through www.aceit.com.au (“our website”), you (“you”, “your”, “the customer”) agree to be bound by these Terms and Conditions and the rights and obligations set out under Australian law, including the Australian Consumer Law (ACL) contained in Schedule 2 of the Competition and Consumer Act 2010 (Cth).

Together, your order, our order confirmation, and these Terms and Conditions form the entire agreement between you and Aceit.

1. Formation of Contract

  • By submitting an order through our website, you make an offer to purchase the selected products.
  • A binding contract is formed once we issue an order reference number via email.
  • We reserve the right to accept or reject any order at our discretion.

2. Supply Within Australia & International Orders

  • We supply and deliver products within Australia.
  • International orders require prior written approval from Aceit. Enquiries must be directed to sales@aceit.com.au.

3. Legal Capacity

  • You must be 18 years or older to place an order on our website.
  • By ordering, you warrant that you have the legal capacity to enter into a binding contract.

4. Processing Your Order

  • After checkout, you will receive an order reference number confirming receipt of your order.
  • Orders undergo internal validation to prevent fraud or unauthorised payments.
  • Once payment is verified, we will issue a Tax Invoice.
  • We reserve the right to:
    • refuse service or supply,
    • cancel orders,
    • terminate accounts,
    • edit or remove website content.
  • If we cannot process your order after payment, we will contact you using the details provided.
  • We may request additional verification to confirm card ownership.

5. Pricing

  • Prices displayed on our website are subject to change without notice.
  • Uniform fulfilment program pricing remains fixed as per agreements with partner organisations.

6. GST

  • All prices include Goods and Services Tax (GST) unless otherwise stated, in accordance with the A New Tax System (Goods and Services Tax) Act 1999 (Cth).

7. Currency

  • All prices and shipping costs are listed in Australian Dollars (AUD).

8. Delivery & Shipping

  • Standard dispatch times:
    • Stock uniforms with decoration: within 5 business days
    • Decorated garments: within 10 business days
    • Custom-made orders: 4–6 weeks
  • Delivery times are estimates only and may vary due to factors outside our control.
  • Deliveries occur Monday–Friday, 9:00am–5:00pm (excluding NSW public holidays).
  • If the courier cannot deliver, a card will be left. You are responsible for arranging redelivery and any additional fees.
  • Changes to delivery details after purchase must be requested by calling 02 42264054 or by email sales@aceit.com.au (quoting order details and number if applicable)

9. Payment Methods

We accept:

  • VISA
  • MasterCard
  • Bank Card
  • PayPal

Additional conditions:

  • Orders placed on weekends or public holidays are processed the next business day.
  • Payment is deemed complete only after successful checkout.
  • Your Tax Invoice serves as proof of purchase for warranty purposes.

10. Title & Risk

  • Title and risk in the products pass to you upon delivery and full payment.

11. Cancelled Orders

  • Orders cannot be cancelled once an order reference number has been issued.
  • We do not provide refunds, credits, or replacements for:
    • change of mind,
    • incorrect selections,
    • failure to verify order details.
  • If Aceit agrees to cancel an order at its discretion:
    • a 25% restocking fee applies, plus any freight costs already incurred.

12. Faulty, Damaged or Defective Products

Under the Australian Consumer Law, you are entitled to a remedy if a product is faulty.

12.1 Our Warranty

If you receive a product that is faulty or damaged due to a manufacturing defect:

  • We will repair or replace the product, or
  • Provide a refund if a replacement is unavailable.

12.2 Warranty Limitations

This warranty does not cover:

  • normal wear and tear
  • impact damage
  • misuse, abuse, or negligence
  • intentional damage
  • exposure to heat, rain, snow, or unsuitable conditions
  • damage caused by solvents, adhesives, or chemicals
  • any damage not caused by defects in materials or workmanship

12.3 Australian Consumer Law Rights

Nothing in these Terms excludes or limits your rights under the ACL. You are entitled to:

  • a replacement or refund for a major failure, and
  • repair or replacement for minor failures.

13. Customer‑Supplied Items

  • Aceit may, at its discretion, agree to decorate, customise, or process items supplied by the customer, including garments, artwork, logos, patches, or accessories.
  • All customer‑supplied items are provided entirely at the customer’s own risk.
  • Aceit accepts no responsibility or liability for:
    • damage, shrinkage, colour variation, or distortion of customer‑supplied garments
    • print or embroidery defects caused by the material or construction of the supplied item
    • loss or damage occurring during handling, production, or decoration
    • the suitability or durability of customer‑supplied items
  • Aceit will not replace, reimburse, or compensate for any customer‑supplied items that are damaged, lost, or rendered unusable during production.
  • This clause does not limit your rights under the Australian Consumer Law in relation to products manufactured or supplied by Aceit.

14. Limitation of Liability

To the extent permitted by law:

  • Aceit is not liable for indirect, incidental, or consequential loss.
  • Our liability is limited to the remedies available under the ACL.

15. Intellectual Property

All content on our website—including images, designs, logos, and text—is the property of Aceit and protected under Australian copyright law. You may not reproduce or use any content without written permission.

16. Privacy

Your personal information is handled in accordance with our Privacy Policy and the Privacy Act 1988 (Cth).

17. Governing Law

These Terms and Conditions are governed by the laws of New South Wales, Australia. Any disputes will be subject to the jurisdiction of NSW courts.
